1. Acceptance of Terms

By accessing or using Biographi ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Biographi is an assisted journaling platform that sends AI-generated prompts to designated individuals ("Storytellers"). The Service is provided "AS IS." We provide the tools for communication but do not curate or monitor the specific content of conversations.

3. User Accounts & Security

You must be 13 years of age or older. You are solely responsible for maintaining the security of your account and for all activities that occur under your account.

4. Consent & SMS Compliance

4a. Storyteller Consent: You represent and warrant that you have obtained express consent from each Storyteller to receive communications via the Service.

4b. SMS Messaging: SMS is optional and not required to use the Service. By enabling SMS, you certify that the Storyteller has provided a separate, affirmative opt-in to receive recurring automated text messages. Consent to SMS is not a condition of any purchase or use of the Service. Message and data rates may apply. Storytellers may opt-out at any time by replying STOP.

4d. Indemnification: You agree to indemnify, defend, and hold harmless Biographi from any claims, losses, or liability (including legal fees) arising from your failure to obtain required consents or your violation of any third-party rights or applicable laws (including the TCPA).

5. Content & License

5a. Ownership: Users and Storytellers retain all intellectual property rights to their submitted content.

5b. Limited License: By using the Service, you grant Biographi a worldwide, non-exclusive, royalty-free license to host, store, transmit, and display your content solely as necessary to provide the Service to you.

5c. No Monitoring: You acknowledge that Biographi does not monitor, screen, or edit the content of prompts or responses. We act as a passive conduit for your private communications.

6. AI-Generated Content

Prompts are generated by artificial intelligence. Biographi does not guarantee the accuracy, appropriateness, or suitability of any AI-generated content. You use these prompts at your own risk.

7. Privacy & Data

We use industry-standard technical safeguards to protect your data. We do not sell personal data. You acknowledge that we use third-party providers (e.g., Stripe, OpenAI, Anthropic, Twilio) to facilitate the Service, and data is shared with them only as required for operation.

8. Subscriptions & Billing

Subscriptions are billed per-storyteller on a recurring basis. All payments are non-refundable, and any refunds are issued at the sole discretion of Biographi. We reserve the right to change pricing upon notice.

9. Acceptable Use

You may not use the Service to harass, threaten, or send unsolicited "spam" messages. We reserve the right to terminate accounts for any violation of these terms without notice.

10. Limitation of Liability

To the maximum extent permitted by law, Biographi and its affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses arising out of or related to the service. To the maximum extent permitted by law, Biographi's aggregate liability for any claim arising out of or relating to the service will not exceed the amounts paid by you for the service in the twelve (12) months preceding the event giving rise to the claim (or, if you have not paid any amounts, $50). Some jurisdictions do not allow certain limitations, so these limitations may not apply to you.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available." We disclaim all warranties, express or implied, including any warranties of merchantability or fitness for a particular purpose. We do not guarantee uninterrupted uptime.

12. Changes & Contact
